Terms and conditions of massage studio Marina – Umění doteku IČ (Tax ID): 86956817
1. Basic provision
1.1. These general terms and conditions govern the legal obligations between the provider of massage services in the SPA studio Marina (hereinafter referred to as the operator) ID number 86956817, in the premises at Vinařického, 37 in Brno Židenice and the buyer of the services provided (hereinafter referred to as the buyer), the visitor of the studio (hereinafter referred to as the visitor ) and the user of the services provided (hereinafter referred to as the customer).
1.2. The operator provides massage services on the basis of a valid trade license and documents certifying professional competence for the activities performed.
1.3 By purchasing a gift voucher, gift certificate, or ordering a specific massage date by phone, both the buyer and the customer show their agreement to the general terms and conditions of the operator.
2. Order service
2.1. Date of the visit
The date of the visit must be agreed and reserved in advance by phone or via the online reservation system
The agreed date is a binding order. The operator reserves the relevant time of the masseur, the capacity and the prescribed temperature of the studio for the agreed date of the customer’s visit.
2.2. Reordering
If, for serious reasons, you cannot attend the massage on the agreed date, please inform us in advance by phone, but no later than 24 hours before the start of the massage. Later reordering is considered the customer’s absence and results in the cancellation of 25% of the price of the ordered procedure.
2.3 Early arrival
The studio premises are not accessible at any time and there is no waiting room in the studio. With regard to other visitors to the massage studio, it is possible to come no earlier than 10 minutes before the agreed date.
2.4. Late arrival
If the customer arrives no more than 15 minutes after the agreed date, the massage will be performed in a shortened range so that it ends at the originally set time. Late arrival for a massage is considered an absence of the customer.
2.5. Absence of customer
In case of absence or arrival for the massage with a delay of more than 15 minutes, the customer will be required to pay the value of the reserved time in the amount of the ordered massage, or it will be directly deducted from the value of the certificate, voucher or free bonus.
2.6. Refusal of massage
Massage can be refused in the following cases:
a) the customer comes to the massage with obvious symptoms of infectious diseases
b) the customer arrives for the massage drunk or under the influence of addictive substances
c) a customer arrives for a massage with health problems of a medical nature
d) the customer arrives for the massage in an unsatisfactory hygienic condition
e) the customer expresses himself in an inappropriate manner while ordering a massage appointment
2.7. Předčasné ukončení masáže
The massage may be terminated early if:
a) during the massage, the customer develops obvious symptoms of infectious diseases, or
b) during the massage, the customer shows obvious signs of intoxication or addictive substances, or
c) during the massage the customer shows obvious symptoms of health problems, or
d) during the massage, the customer will behave in an inappropriate manner despite repeated requests
2.8. Accompaniment and accessibility
A maximum of one adult can accompany the massaged person as a visitor. The studio is not equipped for the presence of dogs, people in wheelchairs, people with other limited mobility and orientation. However, the studio has a space to store bicycles and a dedicated parking space.
2.9. Leaving the studio
The studio provides above-standard customer time comfort. With regard to other visitors to the studio, each customer is expected to leave within 15 minutes after the end of the massage.
2.10. Personal belongings and valuables
The studio provides above-standard customer safety comfort. During the entire massage, the studio is locked for security reasons. However, the operator is not responsible for any possible loss of the client’s belongings before, during or after the massage.
2.11. Informed consent of the customer
Before the first massage, the customer is instructed about health risks, indications and contraindications. If he decides to undergo a massage, he clearly and freely expresses his informed consent.
2.12. Price list of massages
The price list of massages can be viewed in the studio, at the point of sale of gift vouchers and on the website of the operator. Prices are valid for basic operating hours on working days from Monday to Friday. In the case of an agreed massage date on Saturday, Sunday or on holidays, an additional fee of CZK 100 per hour of massage is charged to the price of each massage. All prices include VAT of 21%.
3. Service complaints
When making a complaint about the services provided, the customer must immediately and in a credible manner prove that the subject of the complaint is related to a specific error by the operator. Complaints are submitted in writing to the address of the operator. In the case of an unfounded complaint, the costs of handling it will be recovered from the customer.
4. Gift voucher
4.1. Using a gift voucher
The gift voucher can be used to pay for any relaxing massage offered by the SPA studio Marína massage studio. For a gift voucher with the specified nominal value, the exact type and scope can be agreed when arranging the date of the visit or before the start of the massage. You can find a description of individual massages on the studio’s website.
Payment with a gift voucher must be reported before the start of the massage to verify validity.
4.2. Gift voucher value
Gift vouchers are issued either with a specified nominal value or for a specific type of massage. The unused value of the gift voucher cannot be exchanged back for cash.
4.3. Validity of the gift voucher
A gift voucher is valid as long as its value has not been used up or its validity period has not expired. The certificate can also be used for partial payment with cash payment.
4.4. Expiry date
The period of validity of the gift voucher is six months from the date of sale, indicated on the back of the gift voucher. The services of the massage studio must be used up before the voucher expires at the latest. The validity period cannot be extended.
5. Gift certificate ON-LINE
5.1 Using the certificate
The certificate can be used to pay for any relaxing massage offered by the SPA studio Marína massage studio. The exact type and scope can be agreed upon when arranging the appointment or before the start of the massage. Payment by certificate must be reported before the start of the massage to verify validity.
5.2. Certificate value
The certificate has a value corresponding to the amount that was paid by cashless payment to the account of the Art of Touch massage studio. Before the massage, the variable payment symbol used and the account number from which the payment for the purchase of the gift certificate was made must be communicated. Without this information, this certificate is invalid. The unused value of the certificate cannot be exchanged back for cash.
5.3. Certificate validity
The certificate is valid as long as its value has not been exhausted or its validity period has not expired. The certificate can also be used for partial payment with cash payment.
5.4. Expiry date
The period of validity of the gift certificate is six months from the date of crediting the non-cash payment
on account of the massage studio. The services of the massage studio must be used no later than before the expiration date of the certificate. The validity period cannot be extended.
6. Final Provisions
6.1 Occupational safety and risk prevention in the workplace
By entering the establishment, the customer expresses his consent to his obligation to comply with the rules of occupational safety and risk prevention at the operator’s workplace and the obligation to comply with the safety instructions of the masseuse in charge.
6.2. Validity and effectiveness
These general terms and conditions enter into force and effect on September 10, 2008
